This Privacy Notice explains how Mastercard processes Personal Information in the context of Mastercard Gamer Academy – a program provided by G Esports Holding GmbH (‘the Program’) that is
sponsored by Mastercard. This notice describes the types of Personal Information Mastercard collects, the purposes for which we collect that Personal Information, the other parties with whom we may share it and the measures we take to protect the security of the data. It also tells you about your rights and choices with respect to your Personal Information, and how you can reach us to update your contact
information or get answers to questions you may have about our privacy practices.
Please note that G Esports Holding is the primary data controller for the Program and independently decides how it processes Personal Information in that context. Please read G2 Esport’s Mastercard Gamer Academy Terms and Conditions and Privacy Notice for
more information about how G2 Esports uses your data if you register your interest in the Program, apply and/or are selected to participate.

1. PERSONAL INFORMATION WE MAY COLLECT AND HOW WE USE IT

We may collect the following Personal Information in relation to Mastercard Gamer Academy:

  • Your name, country of residence, video application for Mastercard Gamer Academy and confirmation that you are eligible to take part, if shared with us by G2 Esports for feedback as part of their applicant review process (Application Data).
  • Confirmation that you have passed G2 Esport’s background checks if you are being considered as a Program participant (Eligibility Confirmation).
  • Your name, contact details, date of birth and any other information you share with us, so that we can make travel and/or venue entry arrangements for you in relation to the Program (Travel Information).
  • Any dietary restrictions, access needs or other information you share with us in relation to an event that we sponsor for Program participants, so that we can make necessary arrangements (Event Participation Requirements).
  • Any public social media posts you make referencing Mastercard Gamer Academy and/or Mastercard, so that we can address any violations of the Mastercard Gamer Academy Code of Conduct or issues that are otherwise detrimental to Mastercard (Social Media Posts).
  • Your name, likeness, and any audiovisual or other you create or share as a participant of Mastercard Gamer Academy that we or our partners capture in the context of the Program, to be used for our commercial and promotional purposes. Where required by applicable law, we will seek your consent for such data uses (Promotional Materials).

For the purposes of this Privacy Notice, “Personal Information” means any information relating to an identified or identifiable individual.  

Where applicable, we indicate whether and why you must provide us with your Personal Information, as well as the consequences of failing to do so. If you do not provide Personal Information when requested, you may not be able to take part in activities relating to the Program if we need the information to support those activities, or if we are legally required to collect the data. 

We will only process your Personal Information for the above purposes when we have a valid legal ground for the processing, including if: 

  • You consented to the use of your Personal Information.  
  • We, or a third party, have a legitimate interest in using your Personal Information, for example to enable your participation in events associated with the Program or to protect our brand.
  • The processing is necessary so that we can enforce any affidavits you provide us with in relation to the Program.
  • The processing is necessary for compliance with a legal obligation. 

2. HOW WE SHARE YOUR PERSONAL INFORMATION

  • We may share Personal Information with: 

    • Mastercard’s headquarters in the U.S., our affiliates and other entities within Mastercard’
    • The Program organizer G2 Esports GmbH or other Program partners to make practical arrangements for your participation in activities as part of Mastercard Gamer Academy.
    • Our marketing and travel agencies Octagon Inc, Octagon UK or Ten Lifestyle Group plc.
    • Any other service providers acting on our behalf in relation to the Program.
    • Third parties in the event of a sale or transfer of our business or assets.

We do not share or otherwise disclose Personal Information we collect about you, except as described in this Privacy Notice or otherwise disclosed to you at the time the data is collected. 

We may share the Personal Information we collect with our headquarters and affiliates, including Mastercard International. We may also share your Personal Information with our advertising and travel agencies, who help us enable your participation in activities in relation to the Program if you are accepted as a participant. Our agencies share your Personal Information with other service providers, as necessary, to provide us with these services, for example, airlines and hotels. Please read the privacy notices of these organizations to understand how they process your Personal Information.

We require all service providers by contract to only process Personal Information in accordance with our instructions and as necessary to perform services on our behalf or comply with legal requirements. We also require them to safeguard the security and confidentiality of the Personal Information by implementing appropriate technical and organizational security measures and confidentiality obligations to bind employees who access Personal Information.  

We may disclose Personal Information about you: (i) if we are required to do so by law or legal process, (ii) in response to a request from a court, law enforcement authorities, or government officials, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity. We may also transfer Personal Information we have about you if we sell or transfer all or a portion of our business or assets. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use Personal Information you have provided to us in a manner that is consistent with this Privacy Notice.

3. YOUR RIGHTS AND CHOICES

Subject to applicable law, you may have the right to:

• Access your Personal Information, rectify it, restrict or object to its processing, or request its
deletion.
• Receive the Personal Information you provided to us to transmit it to another company.
• Withdraw any consent you have provided.
• Where applicable, lodge a complaint with your Supervisory Authority.
You can exercise your rights by submitting a request as described in the “How to Contact Us” section.

Subject to applicable law, you may have the right to:

  • Request access to and receive information about the Personal Information we maintain about you, to update and correct inaccuracies in your Personal Information, to restrict or to object to the processing of your Personal Information, to have the information anonymized or deleted, as appropriate, or to exercise your right to data portability to easily transfer information to another company. In addition, you may also have the right to lodge a complaint with a supervisory authority, including in your country of residence, place of work or where an incident took place.
  • Withdraw any consent you previously provided to us regarding the processing of your Personal Information, at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before your consent withdrawal.

These rights may be limited in some circumstances by local law requirements.

4. HOW WE PROTECT YOUR PERSONAL INFORMATION

We maintain appropriate security safeguards to protect your Personal Information and only retain it for a limited period of time.

We maintain appropriate administrative, technical, and physical safeguards to protect Personal Information against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the Personal Information in our possession. We restrict access to Personal Information to those employees who need the information to perform their jobs.

We also take measures to delete your Personal Information, or keep it in a form that does not permit identifying you, when it is no longer necessary for the purposes for which we collected it, or when you request its deletion, unless we are required by law to keep the information for a longer period. We complete periodic reviews of our databases, and have established specific time limits for data deletion, considering the type of data collected, the activity for which we collected the data and whether it has ended, mandatory retention periods, and the statute of limitations.

5. DATA TRANSFERS

We may transfer your Personal Information outside of the EEA, including to the United States, in compliance with our Binding Corporate Rules and other data transfer mechanisms.

Mastercard is a global business. We may transfer or disclose Personal Information we collect about you to recipients in countries other than your country, including to the United States where our global headquarters are located. These countries may not have the same data protection laws as the country in which you initially provided the information. When we transfer or disclose your Personal Information to other countries, we will protect that information as described in this Privacy Notice.

We comply with applicable legal requirements providing adequate safeguards for the transfer of Personal Information to countries other than the country where you are located. In particular, we have established and implemented a set of Binding Corporate Rules (“BCRs”) that have been recognized by EEA and UK data protection authorities as providing an adequate level of protection to the Personal Information we process globally. A copy of our BCRs is available here. We may also transfer Personal Information to countries for which adequacy decisions have been issued, use contractual protections for the transfer of Personal Information to third parties, such as the European Commission’s Standard Contractual Clauses. You can contact us as specified in the “How to Contact Us” section below to obtain a copy of the safeguards we use to transfer Personal Information outside of the EEA.

This Privacy Notice may be updated periodically to reflect changes in our privacy practices.
